Run this past you. management at our nick have started to cancel XODs following the start of the work to rule.

My take is that they can cancel XOD if one or both of the partys are minus hours, however if both are plus hours then the XOD should stand.

Bulletin 8 does not assist - only reference is as follows: "11. At the discretion of the Group Manager and subject to the needs of the work, exchange of duty between staff may be permitted." You might say, if the GM says it can't be done then they havee exercised their discretion. However, might be covered in local agreements. If not, can't see how management can be stopped - it is their discretion. Possibly could argue status quo has been changed, as XOD is a current practice - and management should seek to change the status quo through agreement.
